By accessing or using castopia.ai (the “Service”), operated by Castopia Inc. (“Castopia,” “we,” “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service.

Castopia is an AI-powered marketing platform that helps businesses analyze their brand, generate content and ad creative, schedule and publish posts, and create and manage advertising campaigns — including through integrations with third-party platforms such as TikTok, YouTube, Instagram, and Facebook.

The Service integrates with third-party platforms, including TikTok, YouTube, Instagram, and Facebook, to publish content and manage advertising campaigns on your behalf, with your authorization. Your use of these integrations is also governed by each platform’s own terms and policies, including:

• TikTok’s Terms of Service and Developer Terms
• YouTube’s Terms of Service and API Services Terms
• Meta’s (Facebook/Instagram) Terms and Platform Policy

We access only the data and permissions necessary to provide the features you request, and comply with each platform’s developer requirements. See our Privacy Policy for details on what data we access per platform. Castopia is not responsible for the availability, content, or practices of these third-party platforms.

You must be at least 13 years old, and have the authority to bind the business or organization you represent, to use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, including any connected third-party platform accounts.

You retain ownership of any content you upload or generate through the Service (“User Content”). By submitting User Content, you grant Castopia a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute it solely as necessary to provide the Service (including publishing it to platforms you’ve connected, at your direction).

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or platform policy.
• Upload or publish content that infringes on the intellectual property or other rights of others.
• Attempt to gain unauthorized access to other accounts or systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to transmit spam, malware, or other harmful content.

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms, a connected platform’s policies, or is otherwise harmful to the Service or other users.

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, Castopia and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

You agree to indemnify and hold harmless Castopia, its affiliates, and their officers, directors, employees, and agents from claims, damages, liabilities, and expenses arising from your use of the Service or violation of these Terms.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

We may update these Terms from time to time. We will post the revised Terms here and update the effective date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
